BASIC INFORMATION ON THE PLOT AND ITS ALLOCATION IN THE EMPLOYEE PLOT GARDEN

Matters of the organization of employee allotment gardens, and thus the rules for the use of plots in these gardens, regulated by the Act of 6 May 1981 r. about employee allotment gardens [28]. Under this law, just as it was stipulated in the previous law of 9 brand 1949 r., land intended for employee allotment gardens is transferred by local state administration bodies, i.e.. city ​​governor or president, free of charge for use by the Polish Allotment Association (PZD), they remain the property of the state. The Polish Allotment Association divides the land into plots and builds basic equipment in the allotment garden based on the developed and approved technical documentation (These activities are performed by the Provincial Boards of the PZD on behalf of the Association).

In gardens with a fixed location, the size of the plots may vary from 300 do 500 m2, and in the "temporary."” may be – with the consent of the local state administration body of the basic level (community, city ​​or administrative district) – separated plots of land with an area of ​​up to 1 500 m2.

By allocating plots, The Polish Allotment Association is guided by the following principles: an adult may be a member of the Association, being in an employment relationship, running a craft or service establishment, outworking, receiving an old-age or disability pension or using social assistance, not having its own or leased land with undeveloped area, exceeding 100-200 m2. When allocating plots, mainly people employed in the so-called. arduous professions or in conditions harmful to health, as well as their financial and family situation.

The plot is allocated: in the permanent garden – for an indefinite period, and in the "time garden."” – for a limited period, in accordance with the location decision. Only a member of the Association acquires the right to personal use of the plot assigned to him; he cannot, therefore, arbitrarily switch, lease or other forms of withdrawal in whole or in part of the plot allocated to him.

Allocation of a plot of land to one of the spouses determines the right to use it by both spouses, the spouses may use only one plot of land.

In an already existing garden, the newly admitted member of the Association also pays the predecessor who is leaving the plot, and in the event of his death – heirs, amount, equivalent to an estimate of plantings and devices (valued according to the state on the day of taking over the plot, on the basis of the inventory report and the estimate of an expert appointed by the management of the garden at the expense of the current user of the plot) and for the benefit of the garden an investment fee in the amount determined by the management board. In a newly organized garden, a member pays the amount, representing at least 15% capital expenditure value, per plot, which amount is allocated to the basic garden equipment.

A member of the Association pays a membership fee of a certain amount from 1 m2 of plot, of which the boards of POD transfer to the Provincial Boards of PZD 40% the premium collected. The rest is to cover the expenses included in the garden's budget estimate. In addition, the users of the plots pay fees for the needs of the garden, in the amount determined annually by the general meeting.
